Staccato Warranty Claim

Lifetime Warranty

Subject to the terms, conditions and limitations outlined below, Staccato 2011, LLC (“Staccato”) guarantees its pistols against defects in materials and workmanship that adversely affect their operation for the lifetime of the pistol.

Staccato agrees to correct any defect in the pistol for the original purchaser by repair, adjustment, or replacement, at Staccato’s option, with the same or comparable quality components (or by replacing the pistol at Staccato’s option). The warranty is valid on original ownership only, is not transferable to any other person, and cannot be transferred on resale.

This limited warranty is null and void if the pistol has been misused, damaged (by accident or otherwise), fired with improper ammunition, fired with an obstruction in the barrel, damaged through failure to provide reasonable and necessary maintenance, if unauthorized repair or alteration has been performed on the firearm or any other voids listed in the Staccato Warranty Voids. This limited warranty does not apply to normal wear and tear of any parts.

Subject to the foregoing, this limited warranty confers the right to have the covered pistol or its parts repaired, adjusted or replaced exclusively upon the owner. No implied warranties of any kind are made herein and this warranty does not apply to any accessory items attached, used in connection with, or appurtenant to the pistol. There are no warranties that extend beyond the description on the face hereof. In no event shall Staccato be liable for any incidental or consequential damages arising from or in connection with this limited warranty. Staccato reserves the right to modify, change, replace, amend, or discontinue this limited warranty at any time, with or without notice, at its sole discretion. Any such changes will not affect valid claims submitted prior to the modification. This limited warranty is subject to additional terms, conditions, and other limitations as specified in the product documentation.

In addition, the following terms, conditions and limitations apply:

  • The sole and exclusive remedy pursuant to this warranty is the repair or replacement of your Staccato pistol, at the sole discretion of Staccato.
  • The implied warranties of merchantability and fitness for a particular purpose are expressly limited to one (1) year from the date of the original retail purchase of your pistol.
  • All disclaimers and limitations of liability shall still apply even if the limited remedy of repair and replacement fails of its essential purpose.
  • In states and territories where permitted, Staccato assumes no liability for incidental or consequential damage or for incidental expenses.
  • Any action based on an alleged breach of this warranty must be brought within one (1) year of the claimed breach.
  • This warranty shall not operate to extend the statute of limitations for product liability actions or in any way extend the time limit or the effect of any statute of repose.
  • Any action against Staccato based on an alleged breach of this warranty shall be governed by the substantive law of the State of Texas, without regard to or giving effect of its conflict of laws provisions, and must be brought exclusively in a state court located in Williamson County, Texas, or in the United States District Court for the Western District of Texas.
  • Staccato’s liability for breach of warranty shall be limited to repair or replacement of your pistol, at the sole discretion of Staccato.

Lifetime Warranty Return Procedure

Step 1: Contact Staccato through our website here. A representative from Staccato will help you troubleshoot the issue to see if there are any underlying causes that can be easily remedied without having to return your firearm for repair. For example, these remedies may include, among other things, proper lubrication, cleaning and maintenance, recoil spring replacement, or ammo related issues.

Step 2: If the representative determines your firearm should be returned for repair, a Return Material Authorization (RMA) and Pre-Paid Shipping Label will be generated. Unless otherwise advised, be sure to include the complete firearm in addition to all parts and magazines associated with firing your firearm. When shipping be sure to write the RMA number on the outside of the package and include documentation describing the issue in detail. Unless otherwise advised, DO NOT take your firearm to an FFL to be shipped, but rather take it to an approved shipping center.

*Please Note* Damage due to improper packaging is not covered under warranty.

Step 3: Once your firearm is received we will inspect and test fire it to verify the issue being experienced. Test fire will include a combination of 50 rounds of hollow points and full metal jacket rounds.

Step 4: If we are unable to verify or duplicate the issue, then you will be responsible for the cost of range time, ammo and shipping. This will be charged as a flat cost of $150.00.

Step 5: If we are unable to verify the issue during inspection and test fire you can request that we go back to the range to test fire again. Each additional test fire will be a charge of $50.00. This includes the cost of ammo and labor. The second test fire will be videotaped and a copy returned with your firearm.

If at any time we experience any malfunctions during test firing you will not be responsible for any charges.

PLEASE NOTE THAT STACCATO RESERVES THE RIGHT TO MAKE CHANGES TO THIS POLICY AT ANYTIME WITHOUT NOTICE.
